Federal Licenses and Permits:

Radio and Television Broadcasting

Any individual or business that broadcasts information by radio, television, wire, satellite or cable may be required to obtain a license from The Federal Communications Commission (FCC).  The FCC has recently partnered with other organizations to assist small business in the use and development of new technologies. Contact the License Legal Counsel at The Jacobs Law LLC for assistance completing and filing an application through the FCC’s Universal Licensing System (ULS), Broadcast Radio and Television Electronic Filing System (CDBS), Cable Operations and Licensing System (COALS), International Bureau Electronic Filing System (MyIBFS) or the OET Experimental Licensing System Electronic Filing (for forms 442, 405, 702, 703 and requests for Special Temporary Authority).

Agriculture

The U.S. Department of Agriculture (USDA) requires businesses and individuals who import or transport animals, animal products, biologics, biotechnology or plants across state lines to apply for and obtain a permit. Similarly, if you or your business imports or transports these types of agricultural products into the United States you will be required to comply with various entry and permit requirements established by the USDA and Animal and Plant Health Inspection Service (APHIS). Alcoholic Beverages

Any business that manufactures, imports, or sells alcoholic beverages (including beer, liquor, malt beverages, and wine) at a retail location or wholesale must register the business and obtain certain federal permits (for tax purposes) with the U.S. Treasury’s Alcohol and Tobacco Tax and Trade Bureau (TTB). There are also license requirements at the state level (Alcoholic Beverage Control Boards) as well as possibly the local / municipal level. This application process must be coordinated, and can be quite cumbersome. Even minor mistakes or missing documents or information can result in a denial or significant delays of your license or permit application. Fish and Wildlife

Businesses engaged in wildlife related activities such as the import or export of wildlife or products derived from wildlife, must apply for and obtain the appropriate permit from the U.S. Fish and Wildlife Service.  Commercial Fisheries

Any business engaged in commercial fishing is required to obtain a license for fishing activities from the National Oceanic and Atmospheric Association’s (NOAA) Fisheries Service. The Licensing Legal Counsel at The Jacobs Law LLC can assist you with some of these common fishery-related licenses and permits: HMS International Trade Permit, Atlantic Tunas and Atlantic HMS Permit, Atlantic Tuna Dealer Permit, HMS Chartering Permit, HMS Angling Vessel Permit, Commercial Swordfish or Shark Dealer Permit, Shark Research Fishery/Exempted Fishing Permit, and HMS Tournament Registration.

Maritime Transportation

A business that provides ocean-based shipping of cargo or transportation by sea is required to obtain a license from the Federal Maritime Commission. Related licenses and/or permits include those for Ocean Transportation Intermediaries, Ocean Freight Forwarder, Non-Vessel Operating Common Carriers or Vessel Operating Common Carriers, Passenger Vessel Operators, and Marine Terminal Operators. Applications for these licenses can appear quite burdensome, and there are substantial prerequisites for approval. For example, depending on the type of registered entity (i.e. sole proprietorship, partnership, etc.) the applicant must be an active managing partner, corporate officer  or partner and be a ‘qualified individual’ as defined by 46 C.F.R. §§ 515.2(i), 515.2(l), and 515.11(a). For example, the qualifying individual must have a minimum of three years experience in the ocean transportation intermediary business to be approved. Mining and Drilling

Businesses that drill for natural gas, oil or other mineral resources on federal lands may be required to obtain a drilling permit from the Bureau of Ocean Energy Management and/or Bureau of Safety and Environmental Enforcement (formerly the Minerals Management Service).
