Amazon Brand Registry Requires a USPTO Registered Trademark

If you weren’t paying attention, you might have missed it. Amazon has modified their Brand Registry program and instituted new rules and tools for merchants to protect their brands, logos and products from counterfeiters – Transparency and Project Zero. Not only can merchants register their brand but Amazon uses, and now makes available to merchants, new software tools and features that identify and remove counterfeit goods AND ensure that only legitimate goods are sold by Amazon.

Amazon’s Brand Registry, Transparency and Project Zero are part of a company-wide anti-counterfeiting effort to increase brand-security and brand-protection. Most importantly, Amazon is requiring merchants to provide an active USPTO registered text or image-based trademark along with all the documentation that accompanies such USPTO trademarks. Amazon also added new brand-protection features which include Search & Report tools and proactive brand protection software. The Search & Report tools allow registered brands to scan the global Amazon stores for potential trademark infringement and counterfeit goods.

As part of its new program tools and features, Amazon actively searches for infringement using the information you provide when registering your brand with the Brand Registry. Merchants who sell their branded items on Amazon can sleep well at night knowing that Amazon is actively helping to protect their brands and hottest products from counterfeit sales.

Unfortunately, there has been some criticism that Amazon did not provide earlier or more public warning of the trademark requirements or information on compliance and registration with the Brand Registry. Some merchants have expressed frustration over the USPTO trademark requirements and process of registering with the Brand Registry.
